After being pulled over with enough fentanyl to sustain a drug trafficking charge, my client faced ten years in prison. He had no criminal history and a long, established record of being a productive member of society and positive role model for teenagers. The fentanyl was a reaction to things that had gone very wrong in his life – and a mistake he owned up to.

Together, we created a strategy of building mitigation and seeking the help he needed. As a result of the client’s efforts and my negotiations, he received a deferred sentence (no conviction), even though trafficking fentanyl is one of the most severely prosecuted drug crimes in Oklahoma. The judge even acknowledged she had never seen a plea agreement that good on a fentanyl trafficking case. After a couple years of probation, the case was dismissed.

My client had a new love interest who had moved in with him. After a few weeks, however, the new flame became more and more controlling of my client, and tension rose between them. A scuffle broke out in the living room, but afterwards both parties talked it over and went to sleep. The next morning, police arrived to arrest my client and charged him with kidnapping, assault and battery – for allegedly hitting her in the head with the butt of a handgun.

At a preliminary hearing with the prosecutor, we demonstrated the weakness of their case and the holes in their victim’s story. The prosecutor immediately offered to amend the charges to a single count of misdemeanor assault and battery, with a one-year deferred sentence. After one year of probation, the case was dismissed.

While in the preliminary stages of a divorce, my client’s wife would often become intoxicated and start physical altercations with him. One night, while intoxicated, she assaulted him in their garage. Though my client never hit back, she sustained injuries from falling down drunk. Her solution? She called the police and accused him of beating her.

In the blink of an eye, my client was arrested, taken out of his home, and prohibited from seeing his children. Due to the (false) criminal charges, he also lost his job. I was able to obtain evidence showing my client had never assaulted her – that she had fabricated the entire story. I presented the evidence to the supervising prosecutor and got the case completely dismissed. Since then, my client has been able to restore his reputation and his relationship with his kids, while also fighting back in the divorce.

Charges: Cultivation of a Controlled Dangerous Substance (CDS) Trafficking Marijuana Possession of a Firearm in Commission of Felony

This client owned and operated a medical marijuana farm with several other family members. One day, law enforcement appeared at her home, which was located on the medical marijuana farm. They destroyed all of the medical marijuana plants, removed firearms from a gun safe in her home, and confiscated thousands of dollars in cash.

My client was charged with cultivation of a CDS, trafficking marijuana and possession of a firearm in commission of felony. She faced 10 years in prison for allegedly operating an illegal marijuana farm. After thorough investigation into several years of the farm’s financial and licensing records, I discovered my client was not at fault. I presented these findings to the prosecutor and fought for my client’s inactive role in the licensing process. The case was completely dismissed, and my client’s greatest fears were avoided.

This client had a long criminal history, and had been in and out of prison multiple times. With this charge, he was facing a prison sentence anywhere from ten years to life. His charges were aggravated since he was accused of assaulting a law enforcement officer. I fought the case at a preliminary hearing, showing inconsistencies in the witnesses’ testimony. While we weakened the prosecution’s case in the courtroom, I also created an intense mitigation strategy for my client, including much-needed help to address many of the problems underlying his criminal behavior.

My client’s extensive criminal history made him ineligible to receive probation under Oklahoma law. But with tactful negotiations, a strong courtroom case, and an impressive amount of mitigation, I was able to convince the prosecutor to waive the prison requirement. My client was allowed to stay free and continue to provide for his family on probation.

Charges: Aggravated Possession and Distribution of Illegal Images

Outcome: Sentence Modification: 15-Year Reduction

Before becoming my client, the person in question was charged with aggravated possession and distribution of illegal images. He was represented by another attorney in that case, entered a blind plea and was sentenced to 40 years in prison. After he was convicted and sentenced, I was retained by his family to seek a modification of his sentence.

The case was put back on the docket and the client was brought from prison to face the same judge – this time armed with a different attorney. I fought vigorously for my client by showing the judge how extreme the sentence was compared to federal sentencing guidelines and other cases in and around Pontotoc County. After a three-hour hearing filled with overwhelming evidence, the judge was convinced he had made an error, and reduced the sentence by 15 years. My client was granted 15 more years of life and freedom – all thanks to making the right call.
