Clear Your Record & Liberate Your Future

Expungement & Record Sealing

What is expungement & record sealing in Oklahoma?

Expungement is the legal process of removing or sealing a criminal record, making it inaccessible to the public. In Oklahoma, individuals with certain arrests, charges or convictions may be eligible to have their records expunged under Oklahoma Statutes Title 22 § 18.

Why is Expungement Worthwhile?

A criminal record can be severely detrimental to your life, rights, and future. Without expungement, your record is available to anyone who looks it up. This can result in all of the following and more:

Employment Barriers

Many employers run background checks, and most don’t like to see criminal records of any kind.

Public Access to Records

Criminal records remain publicly available unless expunged.

Housing Restrictions

Landlords may deny rental applications due to criminal history.

Moving On

It may be challenging to move on from a mistake in the past when it continues to come up throughout life.

Professional Licenses

State agencies may not issue a professional license to someone with a criminal record.

A full expungement will seal your record so employers, lenders, banks and anyone else performing a background check won’t find a criminal record. It’s almost as if the conviction never happened.

Under Title 22 § 19, when a criminal record has been expunged, that individual may lawfully state that “no such action has ever occurred.”

Who is Eligible for Expungement?

Expungement eligibility can vary drastically from case to case and the laws determining eligibility change nearly every year. Here are some of the grounds for expungement:

  • Misdemeanor and felony suspended sentences after specific time has passed
  • First-time drug possession offenders who completed a diversion program
  • Those with arrests that did not result in charges
  • Full pardons and certain other rare circumstances
  • Individuals with dismissed cases or acquittals
  • Misdemeanor and felony deferred sentences after specific time has passed

Important Expungement Terms and Definitions

There are a few different types of expungements available under Oklahoma law:

Section 18 Expungement
This is a full sealing of court and arrest records and is what is typically referred to by “expungement.”

Section 991(c) Expungement
This kind of expungement is typically used for deferred sentences, and only removes the court records from being publicly accessed online. However, it does not affect background checks at all.

Juvenile Expungement
This expungement is available for qualifying offenses committed by someone in the juvenile justice system.

Typically three to six months, depending on court processing times and objections from district attorneys or others. Working with Stone Legal Group will ensure all paperwork is filed correctly and your expungement will be processed as fast as possible.
