Guidance on Custody Arrangements in Oklahoma City and Beyond
Child Custody Modification

What is a child custody modification?
According to Oklahoma Statutes Title 43 § 112, A child custody modification is a legal process to change an existing court order that determines physical and/or legal custody of a minor child or children. This could be changing primary physical custody from one parent to another, to grandparents, other relatives or guardians. Child custody modifications in Oklahoma are also necessary to alter the terms of a custody agreement such as visitation schedules.

Child Custody Modifications may Include
- Changing primary physical custody
- Revising visitation schedules
- Altering decision-making authority (legal custody)
When Can Custody Be Modified in Oklahoma?
In Oklahoma, custody modifications are only granted when a substantial change in circumstances has occurred that affects the child’s best interests. This could include, but isn’t limited to:
- A child is at risk of harm or neglect
- One parent is no longer able to care for the child
- Violation of current custody or visitation orders
- A parent relocates or changes jobs
Important Legal Requirements
The requesting party must file a motion to modify and serve the other parent. A court hearing is typically required.
Relocation
If one parent or guardian intends to relocate, Oklahoma law requires the relocating parent to notify the court and the other parent, who may object. The court will evaluate how the move impacts the child’s best interest.
Importance of Legal Representation.
In Oklahoma, the judicial system is tasked with putting the best interest of children first. This means that courts are reluctant to disrupt existing stability in the home – unless there are compelling reasons and evidence that such changes would improve stability and safety.
Stone Legal Group’s experience in family law means we can help present the necessary evidence, file the correct legal documents, and advocate effectively in court.
Key Legal Factors and Standards
There are some important legal factors and standards to understand when attempting a child custody modification in Oklahoma:
Best Interest of the Child Standard
The court’s primary consideration is whether the proposed change serves the child’s emotional, physical and psychological well-being.
Material Change in Circumstances
You must prove a substantial, material and significant change since the last order – not just temporary or minor issues.
Types of Modifications
In Oklahoma, three primary types of child custody modifications exist
- Emergency Custody Orders: When a child is in immediate danger
-
Temporary Modifications: In effect while final resolution is pending
-
Permanent Modifications: Take place after a full hearing

Frequently Asked Questions About Child Custody Modification
Can I change custody without going to court?
Custody can be changed without trial only if both parents agree and submit the new arrangement to the court for approval. Otherwise, a judge must decide based on a formal request.
How often can custody orders be changed?
There’s no legal limit to custody order changes, but repeated modification requests without solid reasons can be denied or seen as harassment by the court. It’s common practice for parties to wait at least six months before seeking modification, but there are exceptions to this general rule.
What qualifies as a material change in circumstances?
Examples of a material change include relocation, substance abuse, neglect, changes in the child’s needs, or a parent’s inability to care for the child due to job loss, illness or incarceration.
Can my child choose which parent to live with?
Oklahoma courts may consider a child’s preference if the child is at least 12 years old, but the final decision is based on the child’s best interest.
What happens if the other parent violates the custody order?
If the other parent violates the custody order, you can file a motion for enforcement, contempt, and possibly seek modification of custody if repeated violations show the current arrangement is not working.
